Terms of Service

1. Agreement

These Terms are a contract between you and Nuvexa (“we”, “us”), the operator of the Faceo app and the api.faceo.bid service (together, the “Service”). By installing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What the Service is – and is not

Faceo takes a photo of a face and uses an AI model to estimate the person’s apparent age and produce an aesthetic score, a short review and styling tips.

• Entertainment only. Results are generated automatically by a machine-learning model that judges only what is visible in one image. They are subjective, may be wrong, may vary between photos of the same person, and may reflect biases in the training data.
• Not advice. Nothing the Service produces is medical, dermatological, psychological, cosmetic-surgery or other professional advice, and nothing is a statement about your worth or anyone else’s. Do not make health, appearance or life decisions based on it.
• Not identification. The Service does not identify people, verify age or identity, or compare faces. Do not use it for any purpose that requires reliable age or identity determination.

3. Who may use it

You must be at least 13 years old (or the minimum age for digital services in your country, if higher). If you are under 18, you confirm that a parent or guardian has agreed to these Terms on your behalf.

4. Your photos

You keep all rights to the photos you submit. By submitting a photo you grant us a limited, non-exclusive licence to transmit, resize, compress and process it, including through our third-party AI provider, solely to produce your result. The photo is discarded once the result is generated, as described in the Privacy Policy.

You confirm that, for every photo you submit:

• you took it yourself or otherwise have the right to use it;
• every person in it is you, or has clearly agreed to have their face analysed by the app;
• it does not show a child under 13, and does not show anyone under 18 unless you are their parent or guardian;
• it is not unlawful, sexually explicit, hateful or intended to harass anyone.

5. Acceptable use

You agree not to:

• use the results to bully, harass, rank, shame or discriminate against anyone;
• circumvent or attempt to circumvent the free daily limit, for example by faking device identifiers, automating requests or reverse-engineering the API;
• scrape, overload, probe or interfere with the Service or its infrastructure;
• decompile or modify the app, or present the Service or its results as your own product;
• use the Service for any purpose that is illegal where you live.

6. Free usage and changes to the Service

Each device receives a fixed number of free analyses per day (currently 10, resetting at midnight, Asia/Ho_Chi_Minh time). We may change the limit, add paid features, modify or discontinue any part of the Service at any time. Analyses that fail because no face is detected or because of a server error are not counted against your limit.

7. Intellectual property

The app, its design, name, logo, code and the text of generated reviews and tips are owned by us or our licensors and are protected by intellectual property laws. You may use your own results for personal, non-commercial purposes, including sharing them on social media.

8. Disclaimer of warranties

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including accuracy of results, fitness for a particular purpose, and uninterrupted or error-free operation.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, special or punitive damages, or for any loss of data, goodwill or emotional distress, arising from your use of, or inability to use, the Service, or from any result it produces. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, which for a free service is zero. Some jurisdictions do not allow certain limitations; in that case these limits apply to the extent permitted.

10. Indemnity

You will defend and indemnify us against claims arising from a photo you submitted without the necessary rights or consent, or from your breach of these Terms.

11. Suspension and termination

We may block a device or stop providing the Service to you at any time if we reasonably believe these Terms have been breached or to protect the Service or other users. You can stop using the Service at any time by uninstalling the app. Sections 4, 7–10 and 12–13 survive termination.

12. Governing law and disputes

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. Any dispute that cannot be settled amicably will be brought before the competent courts of Ho Chi Minh City, Vietnam, unless the mandatory consumer-protection law of your country of residence gives you the right to a different forum.

13. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor of the Service. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.

14. Changes to these Terms

We may update these Terms. Material changes will be announced in the app or on this page with a new effective date. Continued use after the effective date means you accept the new Terms.
